1 Acceptance of Terms

Welcome to LocToc. These Terms of Service ("Terms") constitute a legally binding agreement between you ("User," "you," or "your") and ERC MAX VENTURES PRIVATE LIMITED ("we," "our," or "us"), governing your access to and use of the LocToc mobile application, website, and related backend API services (collectively, the "Platform").

By registering for an account, accessing, or using any part of the Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Platform.

2 Services & Account Registration

LocToc provides a hyperlocal community-focused platform designed to connect neighborhoods, share local updates, report localized issues, recommend services, and view community advertisements.

• Account Creation: To access certain features of the Platform, you must register for an account. Account creation is facilitated via Google OAuth. You are responsible for maintaining the confidentiality of your credentials.
• Accuracy of Information: You agree to provide accurate, current, and complete information during registration and profile updates, including selecting your appropriate residential or business sector.
• Eligibility: You must be at least 13 years of age (or the minimum legal age in your country) to create an account. If you are under the legal age, you may only use the Platform under parent or guardian supervision.

3 Code of Conduct & Restrictions

To ensure a safe, helpful, and welcoming space for all neighborhood members, you agree not to use the Platform to:

• Post content that is unlawful, defamatory, libelous, harassing, threatening, abusive, harmful, or racially or ethnically offensive.
• Submit false reports, fraudulent recommendations, or spread misinformation regarding community events or local issues.
• Impersonate any person or entity, or falsely claim affiliation with any local business, governmental body, or community group.
• Deploy spam, unauthorized advertising, or unsolicited promotional materials (unless officially approved as an Ad Campaign through our administrative panels).
• Engage in scraping, data mining, or attempt to compromise the security, infrastructure, and API services of the Platform.

4 Publisher Roles & Content Moderation

LocToc operates under a moderated publishing system to maintain content quality and safety:

• Publisher Status: Standard users can request to be upgraded to "Publisher" status. All publisher applications are reviewed and approved or rejected by Platform administrators.
• Content Moderation: All posts created by approved Publishers are submitted in a "pending" status and must be verified and approved by our moderation team before appearing in the public feed.
• Rights to Content: We reserve the right (but do not assume the obligation) to edit, reject, delete, or suspend any user content or Publisher account that violates these Terms or our community guidelines.

5 Intellectual Property Rights

Our intellectual property is protected by trademarks, copyrights, and other laws:

• Platform Ownership: The design, layout, source code, database architecture, features, graphics, and branding of LocToc are the exclusive property of ERC MAX VENTURES PRIVATE LIMITED and its licensors.
• User Content License: By posting images, videos, descriptions, or comments on the Platform, you grant us a worldwide, non-exclusive, royalty-free, perpetual, transferable license to host, display, reproduce, and distribute that content on the Platform.

6 Disclaimers & Limitation of Liability

Please read this section carefully as it limits the liability of ERC MAX VENTURES PRIVATE LIMITED:

• "As Is" Basis: The Platform is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.
• User Content Disclaimer: We do not verify, endorse, or assume responsibility for the accuracy or reliability of any post, review, recommendation, or location details uploaded by users or advertisers.
• Limitation of Liability: To the maximum extent permitted by applicable law, ERC MAX VENTURES PRIVATE LIMITED shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill resulting from your use of the Platform.

7 Governing Law & Jurisdiction

These Terms, their interpretation, and any disputes arising out of or in connection with them shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law principles.

Any legal action, suit, or proceeding arising out of these Terms shall be instituted exclusively in the competent courts located in Chandigarh, India.
